Appeals History

Appeals

The OS Appeals Committee considers and decides appeals from parties to a protest or redress hearing and requests for confirmation or correction from protest committees, when these have been delegated from Sail Canada.

Unlike ISAF Cases, which are authoritative, and Sail Canada published Appeals, which are advisable to follow, the decisions published here are for informational purposes only. The decisions from 2009 to 2012 were decided using the The Racing Rules of Sailing 2009-2012 and the decisions from 2013 to 2016 were decided using The Racing Rules of Sailing 2013-2016. The OS Appeals Committee does not review or correct decisions made using previous rules.

How to appeal or request confirmation or correction

Refer to Appendix R in The Racing Rules of Sailing, including Sail Canada Prescriptions, 2017–2020, for the procedures to follow. Appeals and requests for confirmation or correction are to be delivered to Sail Canada. When there is an association appeals committee, such as the OS Appeals Committee, Sail Canada may delegate the appeal or request to that body.

Appeals and requests may be delivered to Sail Canada by e-mail. In fact, this is the preferred method as it speeds the process up considerably. The e-mail address for delivering appeals and requests to Sail Canada is: sailcanada@sailing.ca. There is no fee for making an appeal or request.

Decisions of the OS Appeals Committee may be further appealed to Sail Canada. The decisions of Sail Canada are final.
